There is no fixed time limit as regards proof of damage/fault it is based on a test of what is reasonable, ie what would the reasonable man would consider a timeframe for a fault to become apparent and the question of proof is one of the balance of the probabilities (as with any civil case). There is only one area of strict liability (where the supplier has to prove they are not at fault) and that's the Consumer Protection act, where a product has caused harm. So if the gun had malfunctioned causing harm to another you could sue under the CPA and the supplier would have to prove the gun was not at fault.
From what you describe I'd say the situation is very likely that the issue was at the proofing stage (ie nothing to do with you) however with 6 weeks past since supplying it to you his view (I imagine) is that it's been fired somehow incorrectly which has damaged the barrel.
Not saying who is right or wrong, simply describing the legal position.

Re: Sales of Goods Act
"(a slightly curved barrel that is stopping a cleaning rod from going all the way down the barrel)"
If a cleaning rod won't go all the way down a 16" barrel I wouldn't call it slightly curved, I would say that it is as bent as a banana. Are you sure that it's not one of those German guns for shooting around corners?

Re: Sales of Goods Act
Yay, finally got my Uzi back today....barrel has been changed and now accepts a cleaning rod down its length with no issues party2 .
Took from April to August to get sorted but things moved quickly in the last couple of weeks when I started dropping the word 'Refund' during my many phone calls to the importer to see what was happening....not implying anything, but ......
I really got upset when the importers (outsourced) gunsmith returned the rifle with the original (bent barrel) problem still in place but put in their work notes to the importer that, yes the barrel was bent so he'd changed the barrel shroud (fake moderator) for a new one wtfwtf didn't think to replace the f^%king barrel at the same time though
Many thanks though to Arthur Bales (Cardiff) who shipped and received the rifle to and from the importer (who they deal with) even though they weren't the shop I'd bought it from - the original retailer was 100 miles away and was to far to go back and forward to.
Anyway....Severnside in a weeks time....Uzi is GO
