If you Google "Winchester 94 ae" you will see many pictures of the same type of rifle, it was obviously produced like this for some reason...

Lucky you. The Winchester I grew up with had the problem and we never managed to fix it just lived with it. And I know a few people who also had the same problem. I guess it's like the Marlin jam, some people get lucky!
It's not a massive problem just need to remember not to completely load the tube, and to not let the gate drop.
